These terms and conditions govern your use of the National CCUS Mission website and engagement with NCM's advisory services. Please read them carefully. Last updated: March 2025.

NCM Website and Advisory Services β€” Terms and Conditions

1. Interpretation and Definitions

In these Terms and Conditions: "NCM" means National CCUS Mission, an independent advisory centre registered in India; "Website" means the NCM website at nationalccusmission.in and all subdomains thereof; "Advisory Services" means the consultancy, feasibility, strategic advisory, and related professional services provided by NCM to clients under separate engagement letters; "User" means any person accessing or using the Website; "Client" means any organisation or individual that has entered into an advisory services engagement letter with NCM.

These Terms and Conditions apply to all Users of the Website. Use of the Website constitutes acceptance of these Terms. Advisory Services are governed by the specific terms of each engagement letter, which take precedence over these general Terms in the event of any conflict.

2. Use of the Website

The Website is provided for informational purposes relating to CCUS technologies, policy, sector analysis, and NCM's advisory services. Users may access and read Website content for personal, research, or business informational purposes without charge.

Users may not: reproduce, copy, distribute, or republish any Website content in any form without NCM's prior written consent; use Website content for commercial purposes without NCM's prior written consent; systematically download or scrape Website content using automated tools; frame or embed Website content within other websites without prior written consent; use the Website in any manner that could disable, overburden, or impair NCM's servers or networks.

NCM reserves the right to withdraw access to the Website or any part of it at any time without notice.

3. Intellectual Property

All content on the Website β€” including text, analysis, data, graphics, logos, design elements, and code β€” is the intellectual property of NCM or is used under licence. Nothing on the Website grants Users any licence or right to use NCM's intellectual property except as expressly stated in these Terms.

NCM's Knowledge Hub documents, sector analyses, policy tracker, CBAM exposure analyses, and feasibility frameworks are proprietary works. Reproduction of more than brief quotations (not exceeding 250 words) requires NCM's prior written permission and appropriate attribution.

The NCM name, logo, and "National CCUS Mission" designation are NCM's trademarks and may not be used without prior written consent.

4. Accuracy and Liability Disclaimer

NCM makes reasonable efforts to ensure the accuracy and currency of Website content. However, CCUS technology, policy, market conditions, and scientific understanding evolve rapidly. NCM does not warrant that Website content is accurate, complete, or current at the time of access.

All quantitative data on the Website β€” including CBAM liability estimates, COβ‚‚ intensity figures, project cost estimates, and carbon credit price projections β€” are indicative estimates based on publicly available sources and NCM's professional judgement. They are not investment advice, financial projections, or project-specific assessments and must not be relied upon as such.

To the maximum extent permitted by applicable law, NCM excludes all liability for any loss or damage (including indirect, consequential, or economic loss) arising from reliance on Website content. Users who require project-specific assessments should engage NCM's advisory services under a formal engagement letter.

5. Advisory Services β€” Key Terms

NCM's Advisory Services are subject to individual engagement letters that specify scope, deliverables, fees, timelines, and governance. These Terms and Conditions are incorporated by reference into all NCM engagement letters.

NCM provides its Advisory Services in good faith and with the professional skill and care reasonably expected of independent CCUS advisory professionals. NCM's liability for any claim arising from Advisory Services is limited to the fees paid by the Client under the relevant engagement letter, except in cases of fraud or wilful misconduct.

NCM operates as an independent adviser and does not act as a project developer, technology vendor, equipment supplier, engineering contractor, or financial intermediary. NCM's recommendations do not create any obligation on NCM to participate in project implementation or to assume responsibility for outcomes beyond the advisory scope agreed in the engagement letter.

6. Confidentiality

Information provided to NCM by Clients or prospective clients in the course of advisory engagements or enquiries will be held in confidence and not disclosed to third parties without the Client's consent, except as required by law or regulation, or as necessary to engage specialist sub-advisers under appropriate confidentiality obligations.

NCM may, with appropriate anonymisation, use project and sector data from advisory engagements to develop general sector knowledge and improve NCM's advisory capability. NCM will not publish identifiable client or project information without prior written consent.

7. Data Protection and Privacy

NCM processes personal data in accordance with India's Digital Personal Data Protection Act 2023 and NCM's Privacy Policy, which is published on the Website and incorporated by reference into these Terms.

By using the Website or engaging NCM's services, Users and Clients consent to NCM processing their personal data as described in the Privacy Policy.

8. Governing Law and Dispute Resolution

These Terms and Conditions are governed by the laws of India. Any dispute arising from or in connection with the Website or NCM's services shall first be subject to good-faith negotiation between the parties. If unresolved within 30 days, disputes shall be referred to arbitration in Mumbai under the Arbitration and Conciliation Act 1996, with a sole arbitrator appointed by mutual agreement.

Nothing in these Terms prevents NCM or a User from seeking urgent injunctive or other equitable relief from a court of competent jurisdiction.

9. Amendments

NCM reserves the right to amend these Terms and Conditions at any time. Amendments take effect upon publication on the Website. Continued use of the Website after publication of amended Terms constitutes acceptance of the amended Terms.

Users are encouraged to review these Terms periodically. Significant changes will be notified via a notice on the Website homepage for a period of not less than 30 days after publication.
